Eller & Company - Litigation
"At a time when the US Congress and Senate were creating a firestorm about strategic ownership of American ports, The Policy Partnership implemented a very successful, carefully managed and coordinated programme of media relations and stakeholder communications. They brought the issues across the Atlantic, amplified our key messages, and underpinned, for a sustained period of time, a rather daring litigation strategy which we undertook in the UK High Courts."
Duncan Robertson, Eller & Company
When Miami's port operator, Eller & Company, elected to challenge the rights of the UK listed company Peninsular & Oriental Trading Company (P&O) to sell itself to a new owner, it chose The Policy Partnership as its communications specialists within a hand-picked team of advisers.
The sale of P&O to the Dubai Ports World, which is owned by the Government of Dubai, was a major event in the trading calendar of 2006. The Policy Partnership was tasked to generate questions around the integrity of the sale and to highlight the appropriateness of a strategic asset being sold to a foreign government-owned company.
Working in tandem with US advisers, The Policy Partnership ensured the P&O sale was rigorously scrutinised by politicians, business media, columnists, publications, analysts, financial market watchers, think-tanks and shareholders in the UK and internationally.
The three-month campaign culminated with a six-day litigation in the UK High Courts where Eller's challenge was tracked in minute detail during each day of the hearing.
The Policy Partnership provided counsel to the UK management team of Eller & Company and coordinated all media relations. Stakeholder briefings were developed by the team and provided in face-to-face meetings or disseminated in writing.
Whilst the legal challenge was not successful, the key themes of Eller's campaign reverberated across the globe and featured heavily in debates from the US Senate to the dockyards of the UK.
